Title: Repeals the Instructional Drivers License Requirement for Minors

Vote to amend and pass a bill that repeals the instructional driving requirement for minors seeking their drivers license.

Highlights:

 

  • Defines “teaching parent” as a parent, guardian, or legal custodian of a student who is meeting the attendance requirement who has a valid driver’s license, other than a motorized bicycle license or a temporary restricted license, that permits unaccompanied driving; and who has maintained a clean driving record for the previous 2 years (Sec. 10).

  • Requires a parent, guardian, or legal custodian of a child of compulsory attendance age providing competent private instruction to the child may meet all of the following requirements (Sec. 6):

    • Complete and send, promptly, the report required under this law to the school district of residence of the child;

    • Ensure that the child under the parent’s, guardian’s, or legal custodians instruction is evaluated annually to determine whether the child is making adequate progress; and

    • Ensure that the results of the child’s annual evaluation are reported to the school district of residence of the child and the department of education by a date not later than August 1 of the year following the school year in which the child was under competent private instruction.

  • Requires instruction providing awareness about sharing the road with pedestrians, bicycles, and motorcycles. The instruction course will be first approved by the state department of transportation. Instructional material creating awareness about sharing the road with pedestrians, bicycles, and motorcycles will also be distributed during instruction (Sec. 9).

  • Specifies 30 hours of street or highway driving including three hours of driving after sunset and before sunrise while accompanied by a teacher, parent, or a person who is qualified to provide street or highway driving instruction (Sec. 11-1).

  • Requires the content of the course of instruction required under this law to be equivalent to that required. However, reference and study materials, physical classroom requirements, actual classroom hours and minutes, and extra vehicle safety equipment required for instructions will not be required for the course of instruction provided under this law (Sec. 12).

  • Establishes any student who completed an approved course as provided in this law, passes a driving test to be administered by the department, and is otherwise qualified will be eligible for an intermediate license (Sec. 14). 

  • Specifies this law cannot be construed to mandate a teaching parent to apply for or seek approval of the department separate from the course completion and certification requirements of this law (Sec. 15).
