Title: Women's Health Protection Act of 2021

Vote on a motion to invoke cloture on a bill that establishes a statutory right for health-care professionals to provide abortions.

Highlights:

  • Specifies that a health care provider has the statutory right under this bill to offer and provide abortion services without any of the following prohibitions, limitations or requirements, including, but not limited to (Sec. 4):

    • A requirement that health care providers perform specific tests and medical procedures in connection with the abortion service;

    • A limitation on the health care provider’s ability to prescribe or dispense drugs based on current-evidence based regimens or the provider’s good faith judgement;

    • A limitation on a health care provider’s ability to provide abortion via telemedicine;

    • A requirement or limitation concerning the physical plant, equipment, staffing, or hospital transfer arrangements of facilities where abortion services are provided;

    • A requirement that prior to the abortion procedure the pregnant individual make an in-person visit to the abortion provider or an entity that does not provide abortion services;

    • A prohibition on abortion at any point in time prior to fetal viability, including restrictions on specific procedures;

    • A prohibition on abortion after fetal viability when continuation would pose a risk to the pregnant individual’s life or health;

    • A limitation on the health care provider’s ability to provide immediate abortion services when necessary to prevent risk to a pregnant indivual’s life and health; or

    • A requirement that an individual seeking abortion disclose the reasons for seeking the abortion service.

  • Authorizes the Attorney General to take civil action on behalf of the federal government against any state or government official that implements and enforces a requirement or limitation that violates the aforementioned provisions of section 4 (Sec. 8).

  • Authorizes any private individual or entity, including a health care provider to take civil action against any state or government official that violates the aforementioned provisions of section 4 (Sec. 8).

NOTE: THIS IS A VOTE TO INVOKE CLOTURE ON A MOTION TO PROCEED, WHICH SENDS THE LEGISLATION TO THE FLOOR OF THE SENATE FOR DEBATE AND AMENDMENT. A MOTION TO PROCEED ALONE REQUIRES A MAJORITY FOR APPROVAL. HOWEVER, THE MOTION CAN BE FILIBUSTERED, AND WHEN THIS OCCURS, A CLOTURE VOTE IS NECESSARY TO VOTE ON THE MOTION TO PROCEED. A THREE-FIFTHS MAJORITY OF THE SENATE IS NECESSARY TO INVOKE CLOTURE.
