Vote Smart's Synopsis:

Vote to pass a bill that permits prosecutors to enroll in the Prosecutors Part of Public Employees Retirement System or PERS.

Highlights:

• Prosecutors hired before 2010 shall be members of the Prosecutors Part of the Public Employees' Retirement System and shall be subject to the same membership and benefit provisions as State employees (Sec. 2).

• A prosecutor shall be established in the Prosecutors Part without further assessment of cost to the prosecutor if they have any service credit established (Sec 2a):

• In the Public Employees' Retirement System prior to 2010 (Sec 2a); or

• In the Public Employees' Retirement System and the Judicial Retirement System by a member of the retirement system in any position prior to service as a county prosecutor, nominated and appointed pursuant to Article VII, Section II, paragraph 1 of the  New Jersey Constitution (Sec 2a).

• Any county prosecutor enrolled in the Defined Contribution Retirement Program shall be eligible for service credit in the Prosecutors' Part, except they shall first pay the amount equivalent to that amount contributed during each fiscal year of membership in the Defined Contribution Retirement Program to be credited (Sec 2a).

• A prosecutor who becomes a member of the retirement system after 2010 shall not be a member of the Prosecutors' Part and the benefit provisions of State employees shall not apply to such a prosecutor or the prosecutor's beneficiary (Sec 2a).

• All outstanding obligations, such as loans, shall be satisfied by a prosecutor as previously scheduled for payment to the Public Employees' Retirement System (Sec 2b).
