Vote to pass a bill that prohibits local governments from requiring a license for a person whose job scope does not substantially correspond to that of a contractor or journeyman type licensed.

Highlights:

• Defines "licensing" as any training, education, test, certification, registration, or license that is required for a person to perform an occupation in addition to any associated fee (Sec. 1-1.a).

• Defines "occupation" as a paid job, profession, work, line of work, trade, employment, position, post, career, field, vocation, or craft (Sec. 1-1.c).

• Establishes the licensing of occupations is expressly preempted to the state and this law supersedes any local government licensing requirement of occupations except the following (Sec. 1-2):

• Any local government that imposed licenses on occupations before January 1, 2021. However, any such local government licensing of occupations expires on July 1, 2023; and

• Any local government licensing of occupations authorized by general law.

• Prohibits a local government that licenses occupations and retains the licensing from imposing additional licensing requirements on that occupation or modify such licensing (Sec. 1-3).

• Prohibits local licensing for an occupation that is not authorized under this law or otherwise authorized by general law from applying and from being enforced (Sec. 1-4).

• Prohibits a local government from requiring a person to obtain a license for a job scope that does not substantially correspond to the job scope of one of the contractor categories (Sec. 2).

• Specifies job scopes for which a local government may not require a license include, but are not limited to, painting; flooring; cabinetry; interior remodeling; driveway or tennis court installation; handyman services; decorative stone, tile, marble, granite, or terrazzo installation; plastering; stuccoing; caulking; and canvas awning and ornamental iron installation (Sec. 2).

• Authorizes counties and municipalities to issue journeyman licenses in the plumbing, pipefitting, mechanical, or HVAC trades (Sec. 3-1).

• Authorizes counties and municipalities to issue journeyman licenses in the electrical and alarm system trades (Sec. 4-1).
