Title: Prohibits Transgender Girls from Playing on Female Sports Teams

Vote to override veto of a bill that prohibits transgender girls from playing on female sports teams.

Highlights:

  • Defines public school as both schools maintained by a school corporation and charter schools (Sec. 3).

  • Defines athletic teams and sports impacted by these provisions as, but not limited to the following (Sec. 1):  

    • A team that is organized, sanctioned, or sponsored by a school corporation or public school that competes against another team that is organized, sanctioned, or sponsored by a school corporation, public school, or nonpublic school; and

    • An athletic team or sport that is approved or sanctioned by an association for high school participation

  • Requires that all specified athletic teams be designated as one of the following (Sec. 4): 

    • A male, men's, or boys' team or sport;

    • A female, women's, or girls' team or sport; or

    • A coeducational team or sport.

  • Prohibits an assigned at birth male (transgender female) from participating in any designated female, women’s or girls’ team or sport (Sec. 4). 

  • Requires all applicable school corporations, public schools, nonpublic schools, and associations either (Sec. 5):

    • Establish and maintain a grievance procedure; or 

    • Continuation of an existing grievance or protest procedure if established before July 1, 2022.

  • Authorizes any student or their parent to submit a grievance to the school corporation, public or nonpublic school, or association concerning a violation of these regulations (Sec. 5). 

  • Authorizes any student to bring civil action against a school if a violation deprives them of an athletic opportunity or causes harm – directly or indirectly (Sec. 6).  

  • Prohibits schools from retaliating or taking adverse actions against a student for disclosing a violation or for filing a civil action (Sec. 6).

  • Authorizes that if a court finds the student’s claim to be legitimate, the court may award any of the following (Sec. 7):

    • Injunctive relief;

    • Either the actual and consequential damages from a violation or liquidated damages of no more than $1,000, whichever option is greater;

    • Attorney fees and costs declared valid; and

    • Any other relief the court deems appropriate.

  • Specifies if a school corporation, a public school, a nonpublic school, and an association is acting in good faith in compliance, they are not liable in any civil, administrative, disciplinary, or criminal actions (Sec. 8). 

NOTE: A SIMPLE MAJORITY IS REQUIRED TO OVERRIDE A GOVERNOR'S VETO.
