Title: Specifies Provisions Regarding Banning Mask Mandates

  • Defines “political subdivision” as, but not limited to, the following (Sec. 1): 

    • County;

    • City;

    • Public health district;

    • School district;

    • Special purpose district; or

    • Other districts or municipalities organized under any law of the state.

  • Defines “state” as the state of Idaho or any of its agencies, boards, commissions, departments, divisions, or institutions (Sec. 1).

  • Specifies that “political subdivision” and “state” do not refer to any hospital or health care facility (Sec. 1).

  • Prohibits any political subdivision, official, or the state from mandating that individuals wear a face mask, face shield, or other face covering to slow the spread of an infectious disease (Sec. 1). 

  • Specifies that any political subdivision, official, or the state cannot require a face mask as a condition for entry, education, employment, or other services (Sec. 1). 

  • Requires any recommendation to wear a face covering by a political subdivision, official, or the state be accompanied by a notice stating it is optional (Sec. 1).
