Title: Access to Baby Formula Act

Vote to pass a bill that authorizes the Secretary of Agriculture to waive certain requirements in the special supplemental nutrition program for poorer women, infants, and children (WIC) that limit the brands and quantities of formula that WIC recipients may purchase.

Highlights:

 

  • Authorizes the Department of Agriculture (USDA) to take certain actions to address emergencies, disasters, and supply chain disruptions, specifically the shortage of infant formula in the United States affecting participants of the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) (Sec. 2).

  • Requires the USDA have each infant formula cost containment contract to include remedies in the event of an infant formula recall, including how an infanct formula manufacturer would protect against disruption to WIC participants in the state (Sec. 2).

  • Requires the USDA ensure that there is a memorandum of understanding with the Department of Health and Human Services that includes procedures for coordination and information sharing regarding any supply chaind disruption, including a supplemental food recall (Sec. 2).

  • Authorizes the USDA to waive or modify any WIC qualified administrative requirements during emergencies, disasters, and supply chain disruptions, specifically (Sec. 2):

    • The requirement cannot be met by state agencies during the emergency, disaster, or disruption; and

    • The modifcation or waiver is necessary to provide assistance to WIC participants and does not substantially weaken the nutritional quality of supplemental foods.

  • Authorizes the USDA to waive the maximum monthly allowance for infant formula and establish notification requirements for supply chain disruptions for state agencies (Sec. 2).
