Title: Amends the Delaware Marijuana Control Act

Vote to pass a bill to amend the Delaware Code relating to creation of the Delaware Marijuana Control Act.

Highlights:

  • Authorizes the personal use of marijuana for 21 years old or older and taxed in a manner similar to alcohol so law enforcement can focus on violent crime and property crimes (Page 3).

  • Specifies marijuana must be regulated in the manner similar to alcohol to ensure the following (Page 4):

    • Individuals will have to show proof of age;

    • Selling, distributing, or transferring marijuana individuals under the age of 21 remains illegal;

    • Driving under the influence of marijuana remains illegal;

    • Legitimate, tax paying business people, not criminal actors, conduct sales of marijuana; and

    • Marijuana sold in this state will be tested, labeled, and subject to additional regulations to ensure consumers and informed and protected. 

NOTE: THIS LEGISLATION NEEDED A THREE-FIFTHS MAJORITY VOTE TO PASS.
