Title: Authorizes Sealing of Criminal Records

Vote to pass a bill that authorizes the sealing of certain criminal records.

Highlights:

 

  • Requires that traffic infractions, violations, or any other criminal convictions defined in the laws of this state shall be sealed upon satisfaction of the following conditions, including (Sec. 1):

    • At least 3 yeaers have passed from the imposition of sentence on the defendant’s most recent misdemeanor conviction in this state;

    • At least 7 years have passed from the imposition of sentence on the defendant’s most recent felony conviction in this state;

    • The defendant has no subsequent criminal charges pending in the state;

    • The defendant is not currently under supervision of any probation or parole department for the eligible conviction; and

    • The conviction is not defined as a sex offense.

  • Requires the court of criminal justice to immediately notify the office of curt administration, court of conviction, and the heads of all appropriate police and sheriff departments that the conviction is sealed (Sec. 1).
