Title: Born-Alive Abortion Survivors Protection Act

Vote to pass a bill that establishes requirements for the degree of care a health care practitioner must provide in the case of premature birth following an abortion or attempted abortion.

Highlights:

 

  • Specifies that a health care provider present during an abortion procedure resulting in a premature birth provide the same degree of care as would reasonably be provided to any other premature birth at the same gestational age and immediately admitted to a hospital (Sec. 2).

  • Requires that a health care practitioner or other employee who has knowledge of a failure to comply with the degree-of-care requirements immediately report said failure to law enforcement (Sec. 3).

  • Specifies that a health care practitioner who fails to provide the required degree of care, or a health care practitioner or other employee who fails tot report said failures to law enforcement is subject to a fine, 5 year prison sentence, or both (Sec. 3).

  • Specifies that an individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder (Sec. 3).

  • Prohibits criminal prosecution of a pregnant individual who has an abortion procedure resulting in premature birth and authorizes them to bring a civil action against a health care practitioner or other employee for violations (Sec. 3).
