Title: Prohibits Employers from Denying Employment Due to Positive Cannabis Drug Test

Vote to pass a bill that prohibits employers from denying individuals employment due to a positive cannabis drug test.

Highlights:

  • Classifies the following hiring practiced as unlawful (Sec. 1): 

    • Discriminating based upon the person’s use of cannabis off the job and away from work; and 

    • Discriminating based upon a positive result for a non-psychoactive cannabis substance in a required drug test. 

  • Specifies that this does not apply to individuals applying to a position that a federal government background investigation or security clearance or in the airline or aerospace industries, or any other safety sensitive position for which impairment while working presents a substantial risk of death (Sec. 1).

  • Authorizes employers to require their applicant to be tested for a spectrum of controlled substances, which may include cannabis if the cannabis results are not provided to the employer (Sec. 1). 

  • Specifies that nothing in this section (Sec. 1): 

    • Prohibits basing initial hiring decisions on scientifically valid drug test that do not screen for non-psychoactive cannabis metabolites;

    • Prevents an employers from maintaining an alcohol and drug free workplace; and 

    • Applies to testing that is not pre-employment.
