Title: Establishes 12 Weeks of Paid Family and Medical Leave

Vote to pass a bill that establishes 12 weeks of paid family and medical leave.

Highlights:

  • Establishes a family and medical benefit insurance program (Sec. 6). 

  • Requires the commissioner of this program to pay benefits from the family​

and medical benefit insurance account if (Sec. 7): 

  • The applicant has filed an application for benefits and created a benefits accounts correctly; 

  • The applicant has met all the ongoing eligibility requirements; 

  • The applicant does not have any outstanding overpayments of medical leave​ benefits, including any penalties or interest;​

  • The applicant is not exclusively employed by a private plan employer and has wage credits during the base year attributable to their employer covered under the covered under the state family and​ medical leave program. 

 

  • Specifies that benefits are paid from state funds and are not considered as paid by a special insurance plan or by an employer (Sec. 7). 

  • Specifies that an applicant is eligible for benefits if (Sec. 10): 

    • The week that the applicant is requesting benefits for is within their benefit year;

    • An applicant can not work due to a serious health condition,​ a qualifying exigency, safety leave, family care, bonding, pregnancy, or recovery from​ a pregnancy for a significant period of time; and 

    • An applicant has sufficient wage credits from an employer or employers. 

  • Specifies that you are no longer eligible for benefits due to bonding leave 12 months after birth or placement (Sec. 10).
