Title: Establishes State Extreme Risk Protection Orders
Vote to pass a bill that establishes state extreme risk protection orders.
Defines “respondent” as the individual against whom the extreme risk protection order is filed and is in effect against (Sec. 1).
Authorizes the following individuals to file in a court with proper jurisdiction for an extreme risk protection order against a respondent, including (Sec. 1):
The spouse or former spouse of the respondent;
An individual who has a child in common with the respondent;
An individual who has or has had a dating relationship with with the respondent;
An individual who resides or has resided in the same household with the respondent;
A family member or guardian of the respondent; and
A law enforcement officer or mental health professional.
Requires an indivdual respondent who has a court issue an extreme risk protection issued against them to immediately surrender all of their firearms and ammunition to law enforcement within 24 hours of notice (Sec. 7).
