Title: Banning Cell Phones While Driving
- Specifies that a violation includes text messaging or sending an electronic message using a wireless telephone or electronic communication device (Sec. 1). - Specifies that the ban does not apply to cases in which a wireless telephone or electronic communications device is used by a driver in an emergency situation to communicate with an emergency systems response operator or 911 dispatcher, hospital or emergency room, physician's office or health clinic, ambulance or fire department rescue service, or a law enforcement agency (Sec. 1). - Specifies that a violation of the provisions of this Act shall be a secondary offense, and the driver may only be cited if stopped for a moving violation (Sec. 1). - Establishes the following fines for violators (Sec. 1):
