    Brief Analysis

    Constitutional Amendment No. 5 proposes to amend Article 4, Section 28 of the Constitution of New Mexico to allow a member of the legislature to be appointed to a civil office during the term of the legislature for which the member was elected in limited situations. A member of the legislature may be appointed to civil office if that member resigns from the legislature prior to the appointment and if the civil office was not created, nor the salary for the position increased, during the term from which that member resigned.
