Rosen Helps Introduce Legislation to Safeguard Immigrant Children

Today, U.S. Senator Jacky Rosen (D-NV), a member of the Senate Homeland Security and Governmental Affairs Committee (HSGAC), announced her original co-sponsorship of the Protection of Kids in Detention (PROKID) Act, legislation that would provide additional oversight to ensure the safety of immigrant children in government custody, as well as enact measures for transparency and accountability.

"I'm proud to support this legislation that will provide much-needed oversight to ensure protection, accountability, and humane treatment for all migrant children in any kind of U.S. government custody," said Senator Rosen. "The Trump Administration's cruel family separation policy caused permanent damage to thousands of migrant children, and left a stain on our nation's history as a safe harbor for migrants searching for refuge. I will continue working to ensure the safety of children in our nation's care and keep fighting until all children are treated in a way that aligns with our American values."

BACKGROUND: A key component of the PROKID Act includes the creation of a permanent Office of the Ombudsperson within the Department of Health and Human Services (HHS) to act as an advocate, subject-matter expert, and independent authority responsible for ensuring that the rights afforded to children by the Flores Settlement Agreement, the 2008 Trafficking Victims Protection Reauthorization Act (TVPRA), and other relevant statutes are properly recognized, applied and enforced.

More specifically, PROKID Act would:

Ensure that immigrant children are only held in government custody in the least restrictive setting;
Empower the Ombudsperson to advocate for the quick, safe, and efficient release of immigrant children from government custody whenever possible, including the right to review placement decisions;
Create an expert advisory committee made of up immigration law and child protection specialists to report on trends from the field and advise on best practices; and
Mandate the establishment of a Memorandum of Understanding with the Department of Homeland Security (DHS) to facilitate a close working relationship and ensure visibility, real-time communication, and influence policy and procedures for those children in temporary DHS custody.

ANTECEDENTES: Un componente clave de la Ley PROKID incluye la creación de una Oficina de Defensor del Pueblo Permanente dentro del Departamento de Salud y Servicios Humanos (HHS, por sus siglas en inglés) para actuar como defensor, experto en la materia y autoridad independiente responsable de garantizar que los derechos otorgados a los niños bajo el Acuerdo de Resolución de Flores, la Ley de Reautorización de Protección de Víctimas de 2008 (TVPRA, por sus siglas en inglés) y otras leyes pertinentes sean reconocidas y aplicadas.

Específicamente, la Ley PROKID haría lo siguiente:

Asegurar que los niños inmigrantes solo estén bajo la custodia del gobierno en el entorno menos restrictivo;
Empoderar a la Oficina de Defensor del Pueblo para abogar por la liberación rápida, segura y eficiente de los niños inmigrantes de la custodia del gobierno siempre que sea posible;
