Highlights:

  • Specifies that it is an act of medical negligence to perform or refer a woman for an immediate abortion, except in the case of a medical emergency (Sec. 4).
  • Specifies that an immediate abortion is not an act of medical negligence if, at least 1 hour prior to the performance of an abortion, a physician, physician assistant, psychiatrist, psychologist, registered nurse, clinical professional counselor, or clinical worker has performed all of the following (Sec. 4):
    • Evaluated the pregnant woman to determine whether or not the woman had the perception of feeling pressured or coerced into seeking or consenting to an abortion;
    • Evaluated the woman to identify the presence of any risk factors associated with abortion; and
    • In writing, informed the woman and the physician who is to perform the abortion of the results of the evaluation.
  • Authorizes a woman who has received an immediate abortion to seek damages for the intentional, knowing, or negligent failure of a physician or other licensed person to comply with the requirements of this bill (Sec. 5).
