Vote to pass a bill that amends requirements for health care professionals providing abortions and limits the applicability of foreign law.
Highlights:
Prohibits any individual from performing or attempting to perform a sex-selective abortion (Sec. 5).
Specifies that this bill does not require a physician to question if the sex of the fetus is a “significant factor” to the abortion patient (Sec. 5).
Establishes the following fines for any individual who violates the provisions of this bill (Sec. 5):
$10,000 for the first violation;
$50,000 for the second violation; and
$100,000 for the third and subsequent violations.
Requires a physician performing an abortion to be physically present during the entire abortion procedure (Sec. 6).
Requires an abortion clinic to have standards “similar” to those for the licensure of ambulatory surgical centers (Sec. 6).
Requires an abortion clinic to establish a transfer agreement with a hospital (Sec. 6).
Prohibits the application of “foreign law” that would result in a violation of the constitutional rights of an individual (Sec. 2).
Prohibits health plans offered on the health care exchange operating in North Carolina from providing abortion coverage (Sec. 4).
Specifies that the coverage limitation through the health care exchange will not apply to an abortion when the following conditions are met (Sec.4):
The pregnancy is the result of rape or incest; or
The mother’s life is threatened by a physical disorder, illness, or injury including a life-endangering physical condition caused by or arising from the pregnancy.
