Title: Prohibits Removal of Momuments on Public Property

Vote to pass a bill that prohibits the removal of monuments on public property.

Highlights:

  • Prohibits a local government from removing, relocating, renaming, or otherwise disturbing monuments on public property (Sec. 3).
  • Exempts the following monuments from the provisions of this bill (Sec. 7):
    • Monuments which may interfere with the construction, maintenance, or operation of the public transportation system;
    • Monuments which interfere with providing utility services; and
    • Art, artifacts, and other property under control of museums, archives, libraries, and universities.
  • Prohibits a local government from renaming schools, streets, buildings, bridges, or parks named after an event, group, individual, movement, or military service (Sec. 3).
  • Establishes the Permanent Joint Committee on Alabama Monument Protection, consisting of the following members (Sec. 5):
    • 3 members of the Legislature, appointed by the Governor;
    • 2 members of the Legislature, appointed by the Lieutenant Governor;
    • 1 member from the House of Representatives, appointed by the Speaker of the House of Representatives; and
    • 1 member from the Senate, appointed by the President Pro Tempore of the Senate.
  • Authorizes an entity that controls the property on which a monument is located to petition the Committee for a waiver from the provisions of this bill (Sec. 6).
  • Requires an entity seeking a waiver to take certain actions including, but not limited to, the following actions (Sec. 6):
    • Draft a resolution providing the date, time and location of 2 public hearings and consideration of public input;
    • Provide public notice and advertisement of the resolution for 8 consecutive weeks;
    • Conduct 2 hearings for the collection of input from heritage, historical, genealogical, and preservation organizations, and the general public; and
    • Obtain a certification of completion of the process from the Alabama Historical Commission.
