Title: Increases Penalties for Distracted Driving

A vote to pass a bill that increases penalties for distracted driving, effective October 1, 2017.

Highlights:

  •  Defines “mobile electronic device” as an electronic device not permanently installed in a motor vehicle, including but not limited to devices capable of (Sec. 1):
    • Text messaging;

    • Voice communication;

    • Navigation; and

    • Accessing the internet.

  • Defines “driving” as operating a motor vehicle on a premises open to the public, including during momentary stops due to traffic, traffic control devices, or other temporary delays (Sec. 1).

  • Prohibits holding or using a mobile electronic device for any reason while driving (Sec. 1).

  • Classifies a second offense of driving while using a mobile electronic device within a ten year period as a Class A traffic violation (Sec.1).

  • Classifies a third or subsequent misdemeanor within a ten year period as a Class B misdemeanor and assigns a $2,000 fine (Sec.1).

  • Requires the Department of Transportation to post signs along state highways notifying drivers that it is illegal to operate a vehicle while using a mobile electronic device and that violators are subject to criminal penalties (Sec.1).
