Title: Authorizes Workers to Sue for Unpaid Wages

  • Authorizes an employee to sue to recover the difference between the prevailing wage rate and the amount received by the employee,  if an employee under a public work contract is paid less than the prevailing wage rate for that employee’s classification for the work performed (Sec. 1)

  • Specifies that a determination by the commissioner that a contractor is required to make a restitution under this section does not preclude an employee from filing an action under this section (Sec. 1).

  • Requires the contractor and subcontractor to be jointly and severally liable for any violation of this subcontractor’s obligations under this section (Sec. 1).
