Title: Authorizes Legislative Intervention in Individual Constitutionality Claims and Lawsuits
Vote to pass a bill that authorizes state legislatures to intervene in individual unconstitutionality claims and lawsuits.
Authorizes the legislature and each chamber of the legislature to intervene in any action commenced in any state court whenever the legislature or a house of the legislature deems such intervention necessary in order to protect any right or interest of this state or that body because a party to that action challenges the constitutionality of a state statute, or the validity of legislation or any action of the legislature (Sec. 3A).
Requires that such right exist at any stage of the proceeding, and the legislature and each chamber of the legislature to have the same right to prosecute an appeal , or to apply for a re-hearing or to take any other action or step whatsoever that is had or possessed by any of the parties to such litigation (Sec. 3A).
Specifies that the right of intervention applies to all matters pending in any court of this state (Sec. 3A).
Authorizes each chamber of the legislature to adopt rules or policies to facilitate the operation of this act (Sec. 3A).
Specifies that intervention is not a waiver of legislative immunity (Sec. 3A).
