Title: Prohibits Use of Foam Containers
Vote to pass a bill that prohibits the use of containers made from polystyrene.
Prohibits an individual from selling or offering for sale in the state an expanded polystyrene food service products on or after July 1, 2019 (Sec. 9-2202).
Prohibits a food service business or school from selling or providing food in an expanded polystyrene food service product on or after July 1, 2019 (Sec. 9-2202).
Authorizes a county to impose a penalty on an individual or food service business that violates this act a penalty of no more than $250 (Sec. 9-2206).
Defines “expanded polystyrene” as blown polystyrene and expanded and extruded foams that are thermoplastic petrochemical materials utilizing a styrene monomer and processed by a number of techniques, including fusion of expandable bead polystyrene, injection molding, foam molding, and extrusion-blow molding (Sec. 9-2201).
Defines “expanded polystyrene food service product” as a product made of expanded polystyrene that is used for selling or providing food, and includes the following products (Sec. 9-2201):
Food containers;
Plates;
Hot and cold beverage cups;
Meat and vegetable trays; and
Egg cartons.
Specifies that “expanded polystyrene food service product” does not include (Sec. 9-2201):
Prepackaged soup or other food that a food service business sells or otherwise provides to its customers in expanded polystyrene containers that have been packaged before receipt by the food service business;
Food or beverages that have been packaged in expanded polystyrene containers outside the state before before receipt by the food service business;
Materials used to package raw, uncooked, or butchered meat, fish, poultry, or seafood for off-premises consumption; or
Nonfoam polystyrene food service products.
Defines “food service business” as a business that sells or provides food for consumption on or off the premises in the state, and will include (Sec. 9-2201):
Restaurants, fast food style restaurants and cafes;
Delicatessens;
Coffee shops, supermarkets and grocery stores;
Vending trucks and carts;
Movie theaters and dinner theaters; and
Business and institutional cafeterias, including those operated by or on behalf of the state.
