Title: Amends the State Cash Bail System

Vote to concur with house amendments and pass a bill that amends the state cash bail system.

Highlights:

 

  • Requires a court consider an individual’s ability to pay when setting a bail amount and specifies that the bail amount shall only be an set at a rate in which the individual will be able to repay (Sec. 1).

  • Requires a court provide clear and convincing written evidence that no condition of release would assure the persons return to court or the safety of the community when denying bail (Sec. 1).

  • Specifies that under no circumstance may an arrested individual be delayed a bond hearing before a judge for a period longer than 48 hours, excluding weekends and holidays (Sec. 3).

  • Requires an arrested individual have the right to be represented by counsel in a bond hearing and specifies that if the arrested individual is financially unable to afford one then one will be appointed for the purposes of the hearing (Sec. 3).

  • Specifies that an individual charged with with a non violent felony or misdemeanor shall be released from detention pending trial on the individual’s own recognizance that they will return to court on the required date (Sec. 3).

  • Prohibits individuals charged with a violent felony such as domestic assault, battery, violation of a protection order including stalking, escape or attempted escape from law enforcement from pretrial detention release (Sec. 3).
