Vote to pass with amendment a bill that makes the possession, use, or consumption of marijuana a civil violation for juveniles.

Highlights:

 

  • Amends previous law to classify the intentional use, consumption, or possession of marijuana, other than a personal use quantity, by any person as either (Sec. 1):

    • A class B misdemeanor

    • An unclassified misdemeanor with a fine of no more than $575 and or prison sentence no longer than three months; or 

    • A civil violation with a civil penalty of $100 and routine assessments necessary for civil violation administration along with the forfeiture of the marijuana.

  • Specifies that any individual under twenty-one years of age with a civil violation for marijuana use, consumption, or possession, will face (Sec. 1):

    • A civil penalty between $200 and $500 for a second violation; and

    • An unclassified misdemeanor charge and fine of $100 for a third or subsequent violation. 

  • Specifies that fines not paid within ninety days of final adjudication of these violations will result in the doubling of the fine (Sec. 1).
