Vote to pass a bill that prohibits pregnancy-related discrimination and establishes other provisions to protect pregnant women in the workplace.

Highlights:

 

  • Defines “employer,” for the purpose of determining accommodations for pregnant employees, as a person who has 15 or more employees for each of 20 or more calendar weeks during the year (Sec. 1).

  • Defines “reasonable accommodations” for pregnant employees as the following (Sec. 1):

    • More frequent or longer breaks;

    • Time off to recover from childbirth;

    • Acquisition or modification of equipment;

    • Appropriate seating;

    • Temporary transfer to a less strenuous or hazardous position; 

    • Job restructuring;

    • Light duty;

    • Modified work schedule; and

    • Private space that is not a bathroom for expressing breast milk.

  • Specifies that it is unlawful for an employer to fail to make reasonable accommodations for any employee with limitations related to pregnancy, childbirth, or a related medical condition, unless the employer can demonstrate that the accommodation would impose an undue hardship on their program, enterprise, or business (Sec. 2). 

  • Requires employers to engage in a timely and interactive process with employees to determine effective reasonable accommodations (Sec. 2). 

  • Requires employers to provide written notice of the right to reasonable accommodations for pregnancy, childbirth, and related medical conditions to new and existing employees (Sec. 2).
