Vote to amend and pass a bill that establishes the "Fairness in Women's Sports Act," prohibiting transgender female students from sports designated for females at public high schools and colleges.

Highlights:

 

  • Requires interscholastic, intercollegiate, intramural, or club athletic teams or sports that are sponsored by a primary or secondary school, a public institution of higher education, or any school or institution whose students or teams compete against a public school or institution of higher education to be expressly designated as one of the following based on biological sex (Sec. 1):

    • Males, men, or boys;

    • Females, women, or girls; or

    • Coed or mixed. 

  • Prohibits athletic teams or sports designated for females, women, or girls to be open to students of the male sex (Sec. 1).

  • Specifies that a dispute regarding a student’s sex will be resolved by the school or institution by requesting that the sudent provide a health examination and consent form or another statement signed by the student’s personal health care provider that verifies their biological sex through a routine physical examination relying on one or more of the following (Sec. 1):

    • The student’s reproductive anatomy; 

    • Genetic makeup; or

    • Normal endogenously produced testosterone levels.

  • Requires the state board of education to create rules for schools and institutions to follow regarding the receipt and timely resolution of the above-mentioned disputes consistent with this act (Sec. 1).

  • Authorizes any student deprived of an athletic opportunity or suffering any direct or indirect harm as a result of a violation of this act to bring a private cause of action for injunctive relief, damages, and any other relief available under law against the school or institution of higher education (Sec. 1).

  • Requires interscholastic, intercollegiate, intramural, or club athletic teams or sports sponsored by a public or any school that is a member of the Idaho high school activities association or a public institution of higher education or any higher education institution that is a member of the national collegiate athletic association (NCAA), national association of intercollegiate athletics (NAIA), or national junior college athletic association (NJCAA), to expressly designate as one of the following based on biological sex (Sec. 1):

    • Males, men, or boys;

    • Females, women, or girls; or

    • Coed or mixed. 

  • Prohibits athletic teams or sports designated for females, women, or girls to be open to students of the male sex (Sec. 1).

  • Specifies that a student can establish their sex by presenting a signed physician’s statement indicating their sex based solely on (Sec. 1):

    • The student’s internal and external reproductive anatomy;

    • The student’s normal endogenously produced levels of testosterone; and

    • An analysis of the student’s genetic makeup. 

  • Authorizes any student deprived of an athletic opportunity or suffering any direct or indirect harm as a result of a violation of this act to bring a private cause of action for injunctive relief, damages, and any other relief available under law against the school or institution of higher education (Sec. 1).
