Title: Establishes Liability Protections for Businesses, Schools, and Cities during COVID-19 Pandemic
Vote to pass a bill that establishes liability protections for businesses, schools, cities, and counties during the COVID-19 coronavirus pandemic.
Establishes immunity for persons from civil liability for damages or injury resulting from exposure of an individual to the COVID-19 coronavirus (Sec. 1).
Defines a “person” as any entity recognized in this state including, but not limited to (Sec. 1):
Individuals;
Corporations;
Limited liability companies;
Partnerships;
Associations;
Religious organizations;
Cities;
Counties;
School districts;
Universities or institutions of higher education; and
Other units of local government.
Specifies that “person” does not include any Idaho public health district, the federal government or any of its agencies, the state of Idaho or any of its agencies, except institutions of higher education, and a foreign government or foreign jurisdiction (Sec. 1).
Specifies that immunity does not apply to acts or omissions that constitute an intentional tort or willful or reckless misconduct (Sec. 1).
Specifies that this immunity is in addition to any other immunity protection in state or federal law (Sec. 1)
Specifies that this act expires July 1, 2021 (Sec. 3).
