Title: Requires Hospitals Maintain 3-Month Supply of PPE

Vote to amend and pass a bill that requires hospitals maintain a 3-month supply personal protective equipment (PPE).

Highlights:

 

  • Requires public and private employers of workers in general acute care hospitals to supply employees who provide direct patient care or provide services that directly support patient care with personal protective equipment (PPE) (Sec. 2). 

  • Requires such employers, beginning April 1, 2021, to maintain a 3-month supply of PPE including, but not limited to (Sec. 2):

    • N95 filtering facepiece respirators;

    • Powered air-purifying respirators;

    • Elastomeric air-purifying respirators;

    • Surgical masks;

    • Isolation gowns;

    • Eye protection; and

    • Shoe coverings.

  • Requires the employer to provide an inventory of its stockpile and a copy of its written procedures to the Division of Occupational Safety and Health upon request (Sec. 2). 

  • Establishes a civil penalty of up to $25,000 for each violation to maintain the required supply of equipment (Sec. 2).

  • Requires employers to be prepared to report their highest 7-day consecutive daily average consumption of PPE during the 2019 calendar year, on or before January 15, 2021 (Sec. 2).

  • Requires employers to establish and implement effective written procedures for periodically determining the quantity and types of equipment used in their normal consumption (Sec. 2).
