Title: Prohibits New Landfills in Counties Where 2 or more Already Exist

Vote to pass a bill that prohibits new landfills in counties where 2 or more already exist.

Highlights:

 

  • Authorizes each local non-hazardous solid waste management plan to include (Sec. 1-2):

    • The preferred site or alternative sites for the construction of any additional municipal solid waste management facilities needed to properly manage the quantities of municipal solid waste projected for the service areas covered by the plan, including the factors which provided the basis for identifying the preferred or alternative sites; and

    • The method of implementation of the plan concerning the person who will apply for and acquire the permit for any planned additional facilities and the person who will own or operate any of the facilities.

  • Requires the board of supervisors of the county to publish in at least one newspaper a public notice that describes the plan, specifies the location where it is available for review, and establishes 30 days for comments concerning the plan and a mechanism for submitting those comments (Sec. 1-5.a).

  • Prohibits a solid waste management plan from including any proposed new non-hazardous solid waste sanitary landfill if such new landfill is located within a county having two or more existing permitted non-hazardous solid waste sanitary landfills unless a referendum election has been conducted and approved (Sec. 1-13).

  • Classifies criteria to be considered in location and permitting of non-hazardous solid waste management facilities, which include (Sec. 2-2):

    • Hydrological and geological factors;

    • Natural resources factors;

    • Land use factors;

    • Transportation factors; and

    • Aesthetic factors.

  • Prohibits issuing any permit, grant, or loan for any new non-hazardous solid waste sanitary landfill in a county having two or more existing permitted non-hazardous solid waste sanitary landfills (Sec. 2-3).

  • Establishes the duty of the board of supervisors to call an election after presentation and filing of a proper petition requesting same signed by at least 20% or 1,500, whichever number is the lesser, of the qualified electors of the county (Sec. 3-2).
