Highlights:

 

  • Requires, in any criminal case wherein an offender has been sentenced as a persistent offender, the offender to have a resentencing hearing if a current or past conviction for robbery in the second degree was used as a basis for the finding that the offender was a persistent offender (Sec. 1-1).

  • Authorizes the sentencing court to grant the motion if it finds that a current or past conviction for robbery in the second degree was used as a basis for a finding that the offender was a persistent offender and to immediately set an expedited date for resentencing (Sec. 1-2).

  • Prohibits robbery in the second degree from being considered a most serious offense regardless of when the offense was committed (Sec. 1-3).

  • Specifies any sentence imposed under this chapter shall be determined in accordance with the law in effect when the current offense was committed (Sec. 2).
