  • Prohibits eugenic abortions, which requires a physician not to perform an abortion until they confirm the patient isn’t seeking an abortion for the following reasons (Sec. 1.a):

    • Because of the race of the fetus; or

    • Because of the sex of the fetus; or

    • Because of the presumed presence of down syndrome in the fetus.

  • Prohibits intentionally performing an abortion because of a fetus’s race, sex, or the presumed presence of down syndrome in a fetus(Sec. 1a).

  • Requires a physician to note whether the race, sex, or presumption of Down syndrome was detected prior to the abortion (Sec. 1b).

  • Require a physician to confirm that race, sex, or presumption of Down syndrome were not factors in seeking the abortion (Sec. 1b).

  • Requires the physician signature on the above notes (Sec. 1b).
