Title: Amends the Automatic Voter Registration Initiative

Vote to pass a bill that amends the Automatic Voter Registration Initiative, expands the agencies which provide automatic voter registration services, and authorizes the governor to designate certain agencies of the Executive Department and tribal agencies as an automatic voter registration agency.

Highlights:

 

  • Classifies the following agencies as automatic voter registration agencies (Sec. 3-1):

    • The Department of Motor Vehicles;

    • The Department of Health and Human Services;

    • Any agency designated by the Director of the Department of Health and Human Services to receive applications for Medicaid;

    • The Silver State Health Insurance Exchange;

    • Any agency that has been designated by the Governor as an automatic voter registration agency; and

    • Any agency of an Indian tribe that has been designated by the Governor to be an automatic voter registration agency.

  • Authorizes the Governor to designate any agency in the Executive Department of the State Government as an automatic voter registration agency if the agency collects in the regular course of business from a person applying to the agency to receive any service or assistance sufficient information that demonstrates a person is qualified to vote, including, without limitation, proof of identity, citizenship, residence, and date of birth (Sec. 4-1).

  • Prohibits a county clerk from rejecting an an application to register to vote the information received from an automatic voter registration agency solely on the basis that the information does not contain an electronic facsimile of the signature of a person who is applying to vote or update his or her voter registration information on the statewide voter registration list (Sec. 6-1).

  • Requires an automatic voter registration agency to electronically transmit the following information of a person to the Secretary of State and county clerk using the system (Sec. 22-1):

    • An electronic facsimile of the signature of the person, if the automatic voter registration agency is capable of recording, storing, and transmitting to the county clerk an electronic facsimile of the signature of the person;

    • The first or given name and the surname of the person;

    • The address at which the person actually resides and, if different, the address at which the person may receive mail, including, without limitation, a post office box or general delivery;

    • The date of the person;

    • At least one of the following:

      • The number indicated on the person’s current and valid driver’s license or identification card issued by the Department of Motor Vehicles; or

      • The last 4 digits of the person’s social security number; and

    • A description of the documentation presented to the automatic voter registration agency that indicates the person is a citizen of the United States.

  • Authorizes a person who is not eligible to have his or her voter registration information transmitted by an automatic voter registration agency to the county clerk to still apply to register to vote at the automatic voter registration agency (Sec. 24-1).

  • Specifies if the county clerk determines that a person is eligible to vote, the person will be deemed a registered voter. The person’s name must appear on the statewide voter registration list and the appropriate roster and the person must be provided all sample ballots and other voter information provided to registered voters (Sec. 25-2).
