  • Amends the definition of rape to specify that an individual shall be guilty of rape in the third degree if they engage in vaginal, oral, or anal sexual contact with another individual who is incapable of consent by the following reasons, including (Sec. 1):

    • Being less than 17 years old when the individual was 21;

    • Being less than 15 years old when the individual was 18; or

    • Reason of mental disability or mental incapacitation.

  • Amends the definition of rape to specify that an individual shall be guilty of rape in the first degree if they engage in vaginal, oral, or anal sexual contact with another individual who is incapable of consent by the following reasons, including (Sec. 1):

    • By forcible compulsion;

    • By reason of being physically helpless;

    • Being less than 11 years old; or

    • Being less than 13 years old when the individual is 18.
