Highlights:

 

  • Establishes a statewide paid family leave and medical leave insurance program for covered individuals to provide 12 weeks of paid leave to address serious health conditions (Sec. 1).

  • Defines “covered individual” as an individual that meets the following requirements and conditions, including (Sec. 1).

    • Has been employed for at least 12 months by the employer;

    • Has been employed for at least 1,250 hours of service with the employer during the previous 12 months period;

    • The administrative requirements under this act; and

    • Has submitted an application under this act.

  • Specifies that employers with 10-24 employees during the previous 12 month period shall be subject to only the parental leave provisions of this act and employers with 25 or more employees shall be subject to all parental, family caregiving, and medical leave provisions (Sec. 1).

  • Specifies that “employer” shall not include the following, including (Sec. 1):

    • Businesses with 10 or less employees; or

    • The federal government.

  • Exempts the federal government and businesses with 10 or less employees from being subject to the aforementioned provisions and requirements (Sec. 1).

  • Requires that employers collect and retain information from covered individuals verifying parental leave status, serious health condition, or qualifying exigency when a covered individual submits an application (Sec. 1).

  • Defines “department” as the state Department of Labor (Sec. 1)

  • Authorizes the department to conduct public education campaigns to inform the employees and employers regarding the availability of family and medical leave benefits (Sec. 1).

  • Authorizes the department to use a portion of the funds collected for the family and medical leave programs for the state public education program (Sec. 1).
