Title: Prohibits the Release of Marijuana Convictions

Vote to pass a bill that prohibits the release of certain marijuana convictions of individuals arrested before state law changes.

Highlights:

  • Reduces barriers to employment for people who have been convicted of low-level marijuana possession crimes that would be legal on Jan. 1, 2023 (Sec. 1). 

  • Authorizes criminal justice information to be provided if (Sec. 2):

    • Necessary to avoid imminent danger to life or extensive damage to property;

    • Required by applicable court rules or under an order of a court of this state, another state, or the United States;

    • Information is commonly or traditionally provided by criminal justice agencies in order to identify, locate, or apprehend fugitives or wanted persons or to recover stolen property, or for public reporting of recent arrests, charges, and other criminal justice activity;

    • To a criminal justice agency for a criminal justice activity’

    • Necessary for enforcement of or for a purpose specifically authorized by state or federal law;

    • Specifically authorized by a state or federal law to receive that information;

    • A qualified person, as determined by the agency, for criminal justice research;

    • For any purpose, except that information may not be released if the information is non conviction information;

    • Relating to a serious offense, may be provided to an interested person if the information is requested for the purpose of determining whether to grant a person supervisory or disciplinary power over a minor; and 

    • The person is the subject of the information.
