Vote to concur with Senate amendment and pass a bill that requires criminal background checks for residence building employees.

Highlights:

 

  • Establishes Miya’s Law (Sec. 1).

  • Requires public landlords to have all employees of apartments and residence buildings undergo background checks, including criminal record and sexual offender history in all parts of the country, as a condition of employment (Sec. 2, Pg. 1).

  • Authorizes landlords to disqualify anyone from employment if they have a history of violent criminal behavior or if convicted of a felony or misdemeanor in the first degree (Sec. 2, Pgs. 1 & 2).

  • Authorizes a landlord to enter a residence for the protection and preservation of the establishment if the landlord provides the tenants with a reasonable notice and arrives at a reasonable time, with the following specifications (Sec. 3, Pg. 2).

    • That reasonable notice for the purposes of repair means at least 24 hours in advance;

    • That reasonable time of arrival must be within the hours of 7:30 a.m. and 8:00 p.m.; and

    • That the landlord may otherwise enter a residence if given the consent of the tenants, if the tenants unreasonably withhold consent, if the tenants are absent for at least half the time of a periodic rental payment (half a month, for instance), or if it is an emergency.

  • Requires effective January 1, 2023, that each landlord of a public lodging establishment maintain a complete log of the use and return of keys, and establish policies for the issuance, return, and storage of keys (Sec. 4, Pg. 2).

  • Prohibits a landlord of a public lodging establishment from charging an hourly rate for an accommodation or residence, with the exception of late checkout fees (Sec. 5, Pgs. 2 & 3).

  • Specifies that this act shall take effect upon July 1, 2022 (Sec. 6).
