Vote to concur with house amendments and pass a $1.7 trillion spending bill for various continuing appropriations and extensions acts through September 30, 2023.

Highlights:

 

  • Appropriates $1.7 Trillion for various federal agencies and extends several expiring authorities for fiscal year 2023 to provide funding flexibility or additional appropriations for various programs, including the Department of Homeland Security’s federal intrusiton detection and prevention system and related reporting requirment (Div. A).

  • Extends the authority of the Federal Communications Commission to conduct auctions for electromagnetic spectrum licenses (Div. B, Title I, Sec. 101).

  • Extends special assessment on nonindigent individuals or entities convicted of certain offenses involving sexual abuse or human trafficking and other programs for human-trafficking survivors (Div. B, Title I, Sec. 102).

  • Extends the U.S. Parole Commission through fiscal year 2023 (Div. B, Title I, Sec. 103).

  • Extends the Commodity Futures Trading Commission Customer Protection Fund expenses account (Div. B, Title I, Sec. 104).

  • Exempts the budgetary affects of this bill from the following congressional rules and regulations, including (Div. B, Title II):

    • The Statutory Pay-As-You-Go Act of 2010 (PAYGO);

    • The Senate PAYGO rule; or

    • Certain budget scorekeeping rules.

  • Extends certain increased payment adjustments for low-volume hospitals under Medicare’s inpatient prospective payment system (Div. C, Title I, Sec. 101).

  • Extends the Medicare-Dependent Hospital Program, which provides additional payments to certain small rural hospitals that have a high proportion of Medicare patients (Div. C, Title I, Sec. 102).

  • Extends the increased Medicaid federal matching rate (Federal Medical Assistance Percentage) for U.S. territories (Div. C, Title I, Sec. 103).

  • Reduces funding for the Medicare Improvement Fund (Div. C, Title I, Sec. 104).

  • Extends and provides additional funding for the Maternal, Infant, and Early Childhood Home Visisting Program, which promotes pregnant individuals and parents of young children in certain communities through home visits and partnerships with health, social service, and child development professionals  (Div. C, Title II, Sec. 201).  

  • Extends and provides additional funding for the Stephanie Tubbs Jones Child Welfare Services Program and the MaryLee Allen Promoting Safe and Stable Families Program i.e. Title IV-B child and family services programs (Div. C, Title II, Sec. 202).

  • Authorizes the Critical Path Public-Private Partnerships, through which the Food and Drug Adminstration (FDA) may enter into collaborative agreements with eligible entities to develop projects designed to achieve certain goals, such as fostering medical product innovation and accelerating medical product development (Div. C, Title III, Sec. 301).

  • Authorizes the National Institutes of Health program develop and public a priority list of needs in pediatric therapeutics, and award funds to entities with expertise in conducting research regarding said needs (Div. C, Title III, Sec. 302).

  • Authorizes a program that provides grants or contracts to nonprofit consortia for demonstration projects to promote pediatric device development (Div. C, Title III, Sec. 304).

  • Authorizes an FDA program that provides grants to defray the costs of developing drugs, medical devices, and medical foods for rare diseases or conditions (Div. C, Title III, Sec. 307).

  • Authorizes a provision requireing the FDA to post on its website quarterly reports with information on received generic drug appliation and priorty review applications (Div. C, Title III, Sec. 308).

  • Authorizes the National Oceanic and Atmospheric Administration (NOAA) take action regarding precipitation estimation (Div. D).

  • Requires the NOAA enter an agreement with the National Acadamies of Science, Engineering, and Medicine to conduct a study on the state of practice and research needs for precipitation estimation, including probable maximum precipitation estimation (Div. D).

  • Requires the NOAA, in consideration of the study’s recommendation, consult with relevant partners on the development of a plan to update probable maximum precipitation estimates (Div. D).

  • Authorizes the NOAA to develop guidance regarding probable maximum precipitation estimates that does the following, including (Div. D):

    • Provides the best practices for federal and state regulatory agencies, private meteorological consultants, and other users that perform probable maximum precipitation studies;

    • Considers the recommendations provided in the National Academies study;

    • Facilitates review of the probable maximum precipitation studies by regulatory agencies; and

    • Provides confidence in regional and site-specific probable maximum precipitation estimantes.

NOTE: THIS LEGISLATION NEEDED A THREE-FIFTHS MAJORITY VOTE TO PASS.
