Title: Amends Firearm Waiver Rights for At-Risk Individuals

Vote to concur with house amendments and pass a bill that amends voluntary firearm waiver rights for at-risk individuals.

Highlights:

  • Defines “mental health professional” as a psychiatrist, psychologist, pr physician assistant working with a supervising psychiatrist, psychiatrist advanced registered nurse practitioner, psychiatric nurse, social worker, mental health conselor, marriage and family therapist, or another menthal health professional (Sec. 1).

  • Specifies that an individual will be guilty of a class 4 civil infraction whether as a juvenile or an adult if it is found they are in possession of a firearm after filing a voluntary waiver of firearm rights (Sec. 2). 

  • Authorizes a court to issue up to 2 hours of community restitution in lieu of a montary penalty for any civil infraction under this bill (Sec. 2).

  • Authorizes an individual to file a voluntary waiver of their firearm rights either electronically or in writing (Sec. 3).

  • Requires a family member, mental health professional substance use disorder professional be contacted if the aforementioned filer attempts to purchase a firearm while the voluntary waiver of firearm rights is in effect (Sec. 3).
