Title: Prohibits Private Employers from Requiring the COVID-19 Vaccine

Highlights:

  • Prohibits employers from implementing vaccine mandates or requiring employee's receive the COVID-19 vaccine in order to continue to work in the workplace (Sec. 1).

  • Prohibits employers from taking any adverse action against an employee, contractor, applicant for employment, or applicant for a contract position who refuses to take a COVID-19 vaccine (Sec. 1).

  • Defines “adverse action” as any action taken by an employer that a reasonable individual would consider was for the purpose of punishing, alienating, or otherwise adversely affecting an employee, contractor, applicant for employment, or applicant for a contract position (Sec. 1).

  • Authorizes health care facilities and providers to enforce reasonable policies for individual not vaccinated against COVID-19 including requiring protective medical equipment based on the level of risk the individual presents to patients (Sec. 1).

  • Authorizes employees, contractors, applicants for employments, or applicants for contract work to file a complaint with the commission against an employer whom they believe took an adverse action in violation of this bill, and requires the complaint include the following (Sec. 1):

    • The name of the complaint;

    • The name of the employer; and

    • The nature and description of any alleged adverse action took.

  • Defines “commission” for the purposes of this bill as the Texas Workforce Commission (Sec. 1).
